These Terms and Conditions of Sale and Use, hereinafter the “Terms”, define the conditions under which the services offered on https://host.nc are presented, ordered, provided and used.

1. Provider identification
The services offered on host.nc are provided by:
Hostchilipepper LLC d/b/a HOST.NC
Unless expressly stated otherwise in a quote, invoice, order or specific contract, Hostchilipepper LLC d/b/a HOST.NC (“Hostchilipepper”) is the main contractual provider of the services offered on host.nc, the main seller of HOST.NC services, the legal issuer of invoices and the entity responsible for collecting online payments.
Full provider identification details, including registration details, legal and administrative address and contact information, are available in the Legal Notice.
Legal information
Information relating to the publisher, the administrative holder of the host.nc domain name, the HOST.NC partner and support, and the referenced .NC manager is available in the Legal Notice.
3. Acceptance of the Terms
Any order placed on host.nc implies full acceptance of these Terms.
The client acknowledges having read these Terms before validating the order.
The Precontractual Information presents the essential information to review before ordering.
The complementary documents accessible from these Terms include the Acceptable Use Policy, the Backup and Restoration Policy, the Disclaimer, the Withdrawal Form and the Precontractual Information.
These Terms may be supplemented by special terms, quotes, invoices, specific policies, technical appendices, privacy policies, acceptable use policies or contractual documents specific to certain services.
In the event of a contradiction between these Terms and a specific contractual document accepted by the client, the specific document prevails for the service concerned.
4. Definitions
“Client”: any individual or legal entity ordering a service on host.nc.
“Service”: any service offered on host.nc, including web hosting, domain name, email, SSL certificate, technical assistance, maintenance, migration or related service.
“Client account”: personal area allowing the client to manage orders, invoices, services, support tickets and contact information.
“Domain name”: internet address registered or reserved on behalf of the client with a competent registry or provider.
“Platform”: the host.nc website, client area, order interfaces and associated tools, commercially operated by Hostchilipepper.
5. Services offered
Host.nc offers in particular the following services:
- web hosting;
- domain name reservation, registration or management;
- email services;
- SSL certificates;
- technical assistance;
- website migration;
- CMS installation, including WordPress;
- maintenance or additional services;
- services related to online presence.
The essential characteristics of each service are indicated on the offer presentation page, in the cart, quote, order or client area.
Hostchilipepper may modify, evolve or withdraw certain offers, subject to services already ordered and ongoing contractual commitments.
6. Orders
The client may order a service directly on host.nc, through the client area, by quote or by exchange with commercial support.
Before final validation, the client must check the order details, service characteristics, price, duration, selected options, billing information and any special conditions.
HOST.NC offers are mainly intended for professionals, companies, associations, organizations, public bodies and legal entities. Orders placed by individuals may be subject to manual validation, specific conditions or refusal where the service is not suitable for the applicant profile.
The order is considered firm after validation by the client and receipt of payment, unless otherwise agreed in writing.
Hostchilipepper reserves the right to refuse, suspend or cancel an order in case of inaccurate information, refused payment, suspected fraud, abusive use, technical risk, breach of these Terms or impossibility to provide the service.
7. Prices
Service prices are indicated on host.nc, in the client area, on the quote or on the invoice.
Prices may be expressed in XPF, EUR, USD or AUD depending on the services, available payment methods or order settings.
Unless expressly stated otherwise during the order process or on the invoice, displayed prices correspond to the amounts invoiced by Hostchilipepper LLC d/b/a HOST.NC for HOST.NC services, excluding taxes that may be collected separately where legally required.
Any local taxes, duties, reverse-charge mechanisms or reporting obligations applicable to a professional client, association, organization or legal entity remain subject to that client’s own tax regime, unless Hostchilipepper LLC is legally required to collect them.
Hostchilipepper reserves the right to modify its prices at any time. New prices apply to new orders and future renewals, unless otherwise stated in a specific offer.
8. Payment
Payment for services may be made by the methods offered on host.nc, including payment card, bank transfer or any other payment method available at the time of ordering.
Online payments are processed by third-party payment providers, including Stripe where card payment is offered. HOST.NC subscription payments are collected by Hostchilipepper LLC d/b/a HOST.NC, the main contractual service provider, unless expressly stated otherwise in a quote, invoice, order or specific agreement.
Services are generally activated after effective receipt of payment, unless otherwise agreed.
In case of refused, incomplete, disputed or cancelled payment, Hostchilipepper may suspend or cancel the order concerned.
The client is responsible for the validity of payment methods and for keeping billing information up to date.
9. Billing
Invoices are made available to the client in the client area or sent electronically.
The client must verify the accuracy of billing information before validating the order.
Any request to modify an invoice already issued may be refused if it does not comply with applicable accounting or tax rules.
10. Service duration and renewal
Services may be subscribed for a monthly, annual or any other period indicated when ordering.
Certain services may renew automatically if this option is enabled or provided for in the offer.
For monthly plans, the client may request termination at any time from the client area or through support. Termination stops future renewal of the service. The service remains active until the end of the monthly period already paid, unless otherwise requested by the client or suspended under the applicable conditions. To avoid renewal of the following period, the termination request must be made before the service renewal date.
For annual plans, the client may request termination at expiry or non-renewal of the service at any time from the client area or through support. The service remains active until the end of the annual period already paid, unless otherwise requested by the client or suspended under the applicable conditions. This termination stops future renewal of the service. No prorated refund is due for the current annual period, unless required by mandatory law, due to an error attributable to Hostchilipepper or subject to a specific commercial agreement.
The client remains responsible for renewing services, including domain names. Failure to pay on time may result in suspension, expiration, deletion or loss of the service.
Hostchilipepper cannot be held liable for the loss of a service or domain name resulting from non-renewal, late payment, outdated contact information or lack of response from the client.
11. Domain names
Domain names are registered or reserved according to the applicable rules of the registry concerned.
Availability displayed during a domain name search is provided for information only. It does not constitute a definitive guarantee of allocation.
A domain name is considered registered or reserved only after effective confirmation by the competent registry, validation of the order and receipt of payment.
The client undertakes to provide accurate, complete and up-to-date information for any domain name request.
The client is solely responsible for choosing the domain name, its legal availability and the absence of infringement of third-party rights, including trademarks, trade names, copyright, personal names or intellectual property rights.
Hostchilipepper does not guarantee that a domain name chosen by the client does not infringe third-party rights.
12. Specific case of .NC domain names
.NC domain names are subject to the rules of the .NC registry. Availability displayed during a search is indicative until effective validation.
Requests relating to .NC domains may require manual verification, additional information, supporting documents or validation by the competent registry.
HOST.NC follows up on these requests with the support of a referenced .NC manager when the request requires specific assistance.
Legal entities must in particular have a registered office or establishment in New Caledonia and be identifiable through RIDET, while contacts must be established in New Caledonia with an effective address.
13. Web hosting
Web hosting services allow the client to host a website, files, databases, email accounts or digital content according to the characteristics of the subscribed offer.
The client must comply with the technical limits of the offer, including disk space, bandwidth, number of accounts, server resources, databases, files, emails or any other stated limit.
Hostchilipepper may take limitation, suspension or technical intervention measures in case of excessive use, impact on infrastructure stability, risk to other clients, attack, compromise, spam or breach of these Terms.
14. Email services
When email services are included in the offer, the client is responsible for the use of email accounts, passwords, quotas, sending and content.
The following are prohibited: spam, unsolicited campaigns, phishing, identity theft, sending viruses, malware or dangerous content, use of compromised accounts and unauthorized mass sending.
Hostchilipepper may suspend an email account or related service in case of risk to IP reputation, infrastructure security, other clients or service compliance.
15. Client obligations
The client undertakes to provide accurate and up-to-date information, keep credentials confidential, use the services in accordance with applicable laws, avoid infringing third-party rights, keep websites and tools updated, regularly back up content, respond to support requests when necessary and pay invoices on time.
The client is solely responsible for content hosted, published, transmitted or stored through the services.
16. Prohibited uses
It is strictly prohibited to use the services to host or distribute unlawful content, carry out spam, phishing, fraud or scams, distribute viruses or malicious code, conduct cyberattacks, compromise the security of a third-party system, host content infringing intellectual property rights, distribute hateful, violent, discriminatory or unlawful content, impersonate another person, bypass technical or security rules, or harm the infrastructure, other clients or technical partners.
Hostchilipepper reserves the right to immediately suspend any service presenting a serious risk to security, legality, reputation or infrastructure stability.
17. Technical support
Support is provided according to the terms indicated on the website, in the client area or in the subscribed offer.
Support may include access to the client account, hosting incidents, billing issues, domain names, email services and technical questions related to the subscribed offer.
Unless otherwise stated in a specific offer, support does not necessarily include custom development, code correction, repair of compromised sites, advanced CMS administration, SEO optimization, graphic creation, content writing or interventions not directly related to the ordered service.
18. Backups
Hostchilipepper may implement technical backup systems intended to improve service continuity.
Unless a specific option is expressly subscribed, these backups do not constitute a contractual guarantee of complete or permanent restoration.
The client remains responsible for keeping personal backups of websites, files, databases, emails, content and configurations.
Hostchilipepper cannot be held liable for data loss when the client has not kept personal backups, except in case of proven fault directly attributable to Hostchilipepper.
Applicable conditions are specified in the Backup and Restoration Policy.
19. Security
Hostchilipepper uses reasonable means to ensure the security, stability and availability of the infrastructure.
The client remains responsible for the security of applications, passwords, CMS, plugins, themes, scripts, forms, user accounts and content.
In case of compromise, infection, attack or abnormal behavior, Hostchilipepper may temporarily suspend the service concerned in order to protect the infrastructure, other clients or third parties.
20. Service suspension
Hostchilipepper may suspend all or part of a service in case of unpaid invoice, disputed or cancelled payment, inaccurate client information, abusive use, breach of these Terms, security risk, attack or compromise, spam or phishing, third-party complaint, request from a competent authority, or harm to the infrastructure or other clients.
Where possible, Hostchilipepper will inform the client of the suspension and the measures required for reactivation.
In an emergency, serious risk or legal obligation, suspension may occur without prior notice.
21. Termination
The client may request termination of a service according to the methods available in the client area or through support.
Termination does not automatically entitle the client to reimbursement of periods already paid, except in case of mandatory legal provision, provider error or specific commercial agreement.
Hostchilipepper may terminate a service in case of serious or repeated breach of these Terms, persistent non-payment, unlawful use, risk to the infrastructure or abusive behavior.
At the end of the contract, data associated with the service may be deleted after the expiry of applicable technical or contractual periods. The client must retrieve data before effective termination.
22. Right of withdrawal for consumer clients
When the client is a consumer and the service is ordered remotely, the client may benefit from a legal right of withdrawal of fifteen clear days under the conditions provided by applicable regulations.
For services, the withdrawal period generally runs from acceptance of the offer or conclusion of the contract.
Where the right of withdrawal applies and is validly exercised, withdrawal may give rise to replacement or refund within thirty days, under the conditions provided by applicable regulations.
However, when the client requests immediate performance of the service before the end of the withdrawal period, the client acknowledges that the service may begin immediately and that the right of withdrawal may be limited under applicable regulations.
If the service is fully performed before the end of the withdrawal period with the client’s prior express agreement and, where required, express waiver of the right of withdrawal, the client may lose the right of withdrawal.
For digital services, domain names, activated hosting, technical configuration or personalized services, the client acknowledges that certain operations may be irreversible or incur third-party fees. Domain names are generally non-refundable once the request has been processed, transmitted or validated with the competent registry.
A consumer client wishing to exercise the right of withdrawal may contact Hostchilipepper through a support ticket or by post at the registered / mailing address stated in the Legal Notice.
A withdrawal form is made available where the right of withdrawal applies.
This legal right of withdrawal is separate from the 30-day commercial refund guarantee applicable to certain web hosting plans.
From June 19, 2026, where applicable, an online withdrawal feature may be made available to consumer clients in the interface provided for this purpose.
23. No right of withdrawal for professional clients
When the client acts for professional purposes, the right of withdrawal does not apply, unless otherwise required by mandatory law or specific written agreement.
Any order placed by a professional is firm and final after validation and payment.
24. Refunds
Possible refunds are reviewed on a case-by-case basis.
No refund is due when the service has been activated, used, consumed, configured or provided in accordance with the order, except in case of mandatory legal provision or error attributable to Hostchilipepper.
Fees incurred with third parties, including domain name registries, payment providers, SSL certificates or external technical services, may be non-refundable.
Detailed conditions are specified in the Refund and Cancellation Policy.
25. Liability
Hostchilipepper is bound by a best-efforts obligation in providing the services, unless specifically agreed in writing.
Hostchilipepper does not guarantee that the services will be free from interruption, error, incident, vulnerability, temporary unavailability or disruption related to third parties.
Hostchilipepper’s liability may only be engaged in case of proven fault directly attributable to the provider.
Excluded, within the limits permitted by applicable regulations, are losses of revenue, customers, operations, image, data not backed up by the client, interruptions linked to a third party, configuration errors attributable to the client, attacks or compromises resulting from client negligence and indirect damages.
For professional clients, Hostchilipepper’s total liability, all damages combined, may be limited to the amount paid by the client for the service concerned over the previous twelve months, except in case of gross negligence, intentional fault or mandatory provision to the contrary.

26. Additional legal information
Information relating to the administrative holder of the host.nc domain name, the HOST.NC partner and support, and the referenced .NC manager is available in the Legal Notice.
27. Third-party providers
The provision of services may depend on third-party providers, including infrastructure providers, domain name registries, registrars, payment providers, SSL certificate providers, email providers, security services, support tools, backup services and content delivery networks.
Hostchilipepper cannot be held liable for decisions, interruptions, refusals, delays, outages, price changes, restrictions or incidents attributable to such third-party providers.
28. Personal data
As part of service provision, Hostchilipepper may collect and process personal data relating to clients, users, administrative contacts, technical contacts, billing contacts or end users.
Data processing is described in the Privacy Policy available at: https://host.nc/privacy-policy.
The client undertakes to comply with personal data protection obligations when using the services to collect, host or process data relating to third parties.
When Hostchilipepper acts as technical processor on behalf of the client, applicable conditions are specified in the Data Processing Agreement or in a specific agreement.
29. Confidentiality
Each party undertakes to preserve the confidentiality of non-public information received within the contractual relationship.
This obligation does not apply to information already public, legitimately obtained from a third party, required by a competent authority or necessary for service performance.
30. Force majeure
Hostchilipepper cannot be held liable for a failure or delay resulting from an event reasonably beyond its control, including natural disaster, fire, flood, conflict, strike, major network outage, cyberattack, administrative decision, interruption of a third-party provider, electrical failure, political event, epidemic or any other force majeure event.
31. Changes to the Terms
Hostchilipepper reserves the right to modify these Terms in order to adapt them to changes in services, regulations, infrastructure, offers or its organization.
The applicable version is the version in force on the date of the order or service renewal, unless mandatory provisions provide otherwise.
Substantial changes may be brought to the client’s attention by email, client area notification or publication on the website.

The client is invited to provide all information necessary to process the request: client number, invoice number, service concerned, domain name, description of the issue, screenshots or useful technical elements.
33. Mediation for consumer clients
If the client is a consumer and no amicable solution has been found after a written complaint, the client may, where applicable, use a consumer mediation mechanism free of charge.
The competent mediator will be indicated where its designation is applicable to the services concerned.
34. Applicable law and disputes
These Terms are governed by the law applicable to the activities of Hostchilipepper, subject to mandatory provisions applicable to consumers in their country or territory of residence.
In the event of a dispute, the parties shall attempt to find an amicable solution before taking any legal action.
For consumer clients, no provision of these Terms deprives the consumer of the right to bring proceedings before legally competent courts or of the benefit of mandatory consumer protection rules applicable in the consumer’s country or territory of residence.
For professional clients, unless otherwise required by mandatory law or specifically provided in a quote, order, invoice or specific contract, disputes will be submitted to the competent courts under ordinary rules of law.
