This Precontractual Information presents the essential information relating to services offered on https://host.nc before any order.

It supplements the Terms and Conditions of Sale and Use, the Legal Notice, the Privacy Policy, the Cookie Policy, the Acceptable Use Policy, the Backup and Restoration Policy, the Refund and Cancellation Policy, and any other applicable contractual document.

1. Provider identity

Unless expressly stated otherwise in a quote, invoice, order or specific contract, Hostchilipepper LLC d/b/a HOST.NC (“Hostchilipepper”) is the main contractual provider of the services offered on host.nc, the main seller of HOST.NC services, the legal issuer of invoices and the entity responsible for collecting online payments.

Information relating to the publisher, the administrative holder of the host.nc domain name, the HOST.NC partner and support, and the referenced .NC manager is available in the Legal Notice.

3. Services offered

Host.nc offers web hosting, domain name reservation, registration or management, .nc domain names, email services, SSL certificates, website installation or migration, technical assistance, maintenance or complementary services and services related to online presence.

The essential characteristics of each service are stated on the offer page, in the cart, quote, order, invoice or client area. Before validation, the client must check that the selected offer matches the client’s needs.

4. Essential service characteristics

Main characteristics may include disk space, bandwidth, number of websites, number of email accounts, databases, SSL certificates, commitment period, billing period, included options, paid options, support methods, renewal conditions, technical limits and suspension or termination conditions.

Hosting services are provided according to the limits and characteristics stated in the subscribed offer.

5. Price

Prices are shown on host.nc, in the cart, quote, invoice or client area. They may be expressed in XPF, EUR, USD or AUD depending on the services, order settings and available payment methods.

Before order validation, the client is informed of the total price to pay, including where applicable the service price, selected options, billing period, possible fees, taxes that may be collected separately where legally required, possible renewals and order total.

Prices may change. Applicable prices are those confirmed at the time of order or renewal.

6. Payment methods

Available payment methods may include payment card, bank transfer or any other method offered at the time of order.

Online payments are processed by third-party payment providers, including Stripe where card payment is offered. HOST.NC subscription payments are collected by Hostchilipepper LLC d/b/a HOST.NC, the main contractual service provider, unless expressly stated otherwise.

Services are generally activated after order validation and effective receipt of payment, unless specifically agreed. In case of refused, disputed, incomplete or cancelled payment, the order may be suspended, refused or cancelled.

7. Contract duration and renewal

Services may be subscribed for a monthly, annual or any other duration stated at the time of order. The applicable duration is specified before order validation.

At the end of the subscribed period, the service may be renewed automatically or manually according to the conditions stated in the offer, client area or applicable contractual documents. The client is responsible for renewing services, especially domain names.

For monthly plans, the client may request termination at any time from the client area or through support. Termination stops future renewal of the service. The service remains active until the end of the monthly period already paid. To avoid renewal of the following period, the request must be made before the service renewal date.

For annual plans, the client may request termination at expiry or non-renewal of the service at any time. The service remains active until the end of the annual period already paid. No prorated refund is due for the current annual period, unless required by mandatory law, due to an error attributable to Hostchilipepper or subject to a specific commercial agreement.

Failure to pay or renew may result in suspension, expiration, deletion or loss of the relevant service. Domain name renewals may be irreversible once transmitted to the competent registry or registrar.

8. Delivery and service activation

Digital services are not physically delivered. Depending on the service, activation may be automatic after payment, manual after verification, subject to additional information, subject to technical validation, subject to validation by a registry or third-party provider, or delayed in case of checks, error, unavailability or detected risk.

Activation timeframes are indicative, unless specifically agreed in writing.

9. Domain names and .NC domains

Displayed availability during a domain name search is indicative. A domain name is considered reserved, registered or allocated only after effective validation by the competent registry or provider.

The client is solely responsible for choosing the domain name, spelling, extension and ensuring absence of infringement of third-party rights. Once transmitted to the registry, domain registration, transfer or renewal may be irreversible and non-refundable.

.NC domain names are subject to the rules of the .NC registry. Availability displayed during a search is indicative until effective validation.

Requests relating to .NC domains may require manual verification, additional information, supporting documents or validation by the competent registry.

HOST.NC follows up on these requests with the support of a referenced .NC manager when the request requires specific assistance.

Legal entities must in particular have a registered office or establishment in New Caledonia and be identifiable through RIDET, while contacts must be established in New Caledonia with an effective address.

10. Right of withdrawal for consumer clients

When the client acts as a consumer and the order is concluded remotely, the client may benefit from a legal right of withdrawal of fifteen clear days under applicable regulations.

For services, this period generally runs from acceptance of the offer, except where performance has begun with the consumer’s agreement or in other exclusion cases provided by applicable regulations.

The client may exercise the right of withdrawal by sending a clear statement to Hostchilipepper through a support ticket. A withdrawal form is available on host.nc.

The client does not have to provide a reason when validly exercising the right of withdrawal.

11. Immediate service performance

Certain services may be activated quickly after order, including web hosting, client area, email services, SSL certificates, domain names, installation or migration, technical service and personalized configuration.

When the client requests immediate service performance before the end of the withdrawal period, the client acknowledges that the service may begin immediately. If the service is fully performed before the end of the withdrawal period with the client’s prior agreement, the client may lose the right of withdrawal under applicable regulations.

If the service has started but has not been fully performed, a partial refund may be calculated taking into account the service already provided and costs incurred.

12. Refund exclusions or limits

Certain services may be non-refundable or partially refundable where they have been activated, personalized, consumed or transmitted to a third-party provider.

This may include registered domain names, domain name renewals, .nc domains after procedures have begun, issued SSL certificates, technical services started, migrations started, personalized installations, activated hosting services, options already consumed and fees incurred with third-party providers.

13. Professional clients

When the client acts for professional purposes, the right of withdrawal does not apply, unless otherwise required by mandatory law or specifically agreed in writing.

Any validated and paid professional order is considered firm, subject to conditions applicable to the relevant service.

14. Acceptable use conditions

The client undertakes to use the services in accordance with applicable laws, the Terms and Conditions of Sale and Use and the Acceptable Use Policy.

Spam, phishing, malware, manifestly unlawful content, infringement of third-party rights, fraud, identity theft, cyberattacks, abusive infrastructure overload and use contrary to security rules are prohibited. A breach of applicable rules may result in suspension, limitation or termination of the service.

15. Backups

Technical backups may be performed according to available offers and tools. Unless a specific option is expressly subscribed, these backups do not constitute a contractual guarantee of complete, permanent or systematic restoration.

The client remains responsible for keeping independent personal backups of websites, files, databases, emails and configurations. Applicable conditions are specified in the Backup and Restoration Policy.

16. Personal data

Hostchilipepper processes certain personal data to manage orders, client accounts, payments, invoices, support, security and associated services. Detailed information is available in the Privacy Policy.

When the client hosts a website, forms, databases or applications, the client remains responsible for personal data collected from its own users.

17. Third-party services

Service provision may depend on third-party providers, including domain name registries, registrars, infrastructure providers, payment providers, SSL certificate providers, email providers, security tools, DNS services and support tools.

Hostchilipepper cannot guarantee decisions, delays, interruptions, refusals, restrictions or price changes attributable to these third parties.
